Diagnofi Limited ("Diagnofi," "we," "us," or "our") operates a digital healthcare platform at www.diagnofi.odoo.com, providing laboratory testing services, diagnostic services, telemedicine consultations, and appointment booking services. Our registered office is located at Mazar Road, Mirpur-1, Dhaka-1212, Bangladesh.
By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately.
1. DEFINITIONS
- "Platform" refers to www.diagnofi.odoo.com and all associated mobile applications and services
- "Services" includes laboratory tests, diagnostic services, telemedicine consultations, appointment booking, and related healthcare services
- "User" or "You" refers to any person accessing or using the Platform
- "Healthcare Provider" refers to laboratories, diagnostic centers, doctors, and medical professionals partnered with Diagnofi
- "Patient" refers to the individual receiving healthcare services through the Platform
- "Health Information" means any medical, diagnostic, or health-related data submitted or generated through our Services
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 Age Requirements
- You must be at least 18 years old to create an account
- Minors may use Services only with parental or legal guardian consent and supervision
- The account holder is responsible for all activities under their account
2.2 Account Security
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your password and account credentials
- You must immediately notify us of any unauthorized access or security breach
- Sharing account credentials is strictly prohibited
2.3 Account Verification
- We reserve the right to verify your identity and contact information
- False information may result in immediate account
suspension or termination
3. HEALTHCARE SERVICES
3.1 Laboratory and Diagnostic Services
- Laboratory tests and diagnostic services are provided by licensed Healthcare Providers in our network
- Test results are for informational purposes and should be reviewed with a qualified healthcare professional
- We do not guarantee specific medical outcomes or diagnoses
- Sample collection, processing, and testing follow standard medical protocols
- Turnaround times are estimates and may vary based on test complexity and circumstances
3.2 Telemedicine Services
- Telemedicine consultations are conducted by licensed medical professionals
- Consultations do not replace in-person medical examinations when clinically necessary
- In emergency situations, contact local emergency services immediately
- Prescriptions issued through telemedicine comply with applicable medical regulations
- We do not provide services for controlled substances or certain medications as per regulations
3.3 Appointment Booking
- Appointments are subject to Healthcare Provider availability
- You must arrive on time for scheduled appointments
- Cancellation and rescheduling policies vary by Healthcare Provider and will be communicated at booking
- No-shows may result in cancellation fees or service restrictions
3.4 Service Limitations
- Services are available only in geographic areas where we operate
- Certain tests or services may require prior authorization or medical justification
- We reserve the right to refuse services that are medically inappropriate or unavailable
4. USER RESPONSIBILITIES
4.1 Accurate Health Information
- You must provide complete and accurate health information, including medical history, current medications, and allergies
- Withholding or falsifying health information may compromise your care and safety
- You are responsible for updating your health information as it changes
4.2 Following Medical Instructions
- You must follow pre-test preparation instructions (fasting, medication restrictions, etc.)
- Failure to follow instructions may affect test accuracy and require retesting at your expense
4.3 Prohibited Uses
You must not use the Platform to:
- Obtain services fraudulently or using false information
- Request medically unnecessary tests or services
- Seek controlled substances inappropriately
- Harass, threaten, or abuse Healthcare Providers or staff
- Share or sell prescription medications obtained through our Services
- Violate any healthcare laws or regulations
- Attempt to diagnose or treat others without proper medical licensure
- Upload malicious code, viruses, or harmful software
- Scrape, copy, or extract data from the Platform without authorization
- Impersonate any person or entity
5. PRIVACY AND HEALTH INFORMATION
5.1 Data Collection and Use
- We collect, store, and process your Health Information in accordance with our Privacy Policy
- Your Health Information is protected under applicable data protection and healthcare privacy laws
- We implement appropriate security measures to protect your data
5.2 Information Sharing
- Health Information is shared with Healthcare Providers only as necessary to deliver Services
- We do not sell your Health Information to third parties
- We may share anonymized, aggregated data for research and quality improvement
- Legal obligations may require disclosure to regulatory authorities or law enforcement
5.3 Your Rights
- You have the right to access, correct, and request deletion of your personal information
- You may request copies of your medical records and test results
- You can withdraw consent for non-essential data processing
6. FEES AND PAYMENT
6.1 Service Fees
- Fees for Services are displayed prior to booking or purchase
- Prices are subject to change without notice
- All fees are in Bangladeshi Taka (BDT) unless otherwise stated
6.2 Payment Methods
- We accept payment methods displayed on the Platform
- Payment must be completed before service delivery unless alternative arrangements are made
- You authorize us to charge your selected payment method
6.3 Refunds and Cancellations
- Refund policies vary by service type and Healthcare Provider
- Cancellations made within the specified timeframe may be eligible for refunds
- Test samples already collected or processed are generally non-refundable
- Completed telemedicine consultations are non-refundable
6.4 Insurance and Third-Party Payment
- If using insurance, you are responsible for verifying coverage
- You remain responsible for any amounts not covered by insurance
- We are not responsible for insurance claim denials or delays
7. INTELLECTUAL PROPERTY
7.1 Platform Content
- All content on the Platform, including text, graphics, logos, software, and design, is owned by Diagnofi or licensed to us
- You may not reproduce, distribute, modify, or create derivative works without written permission
7.2 User Content
- You retain ownership of health information and content you submit
- By using our Services, you grant us a limited license to use your information to provide Services
- You grant us the right to use anonymized data for quality improvement and research
7.3 Trademarks
- "Diagnofi" and associated logos are trademarks of Diagnofi Limited
- Unauthorized use of our trademarks is prohibited
8. Not Emergency Services
- The Platform is not for medical emergencies
- In emergencies, call emergency services (999 in Bangladesh) or visit the nearest hospital
9. LIABILITY AND INDEMNIFICATION
9.1 Healthcare Provider Responsibility
- Healthcare Providers are independent professionals responsible for their own services
- Diagnofi is not liable for Healthcare Provider actions, omissions, or quality of care
- Complaints about Healthcare Providers should be directed to appropriate regulatory bodies
9.2 User Indemnification
You agree to indemnify and hold harmless Diagnofi, its affiliates, Healthcare Providers, directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any laws or regulations
- Your misuse of the Platform or Services
- Your provision of false or misleading information
- Your violation of third-party rights
- Your negligence or willful misconduct
10. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of Bangladesh, including but not limited to:
- The Digital Security Act, 2018
- The Information and Communication Technology Act, 2006
- The Medical Practice and Private Clinics and Laboratories (Regulation) Ordinance, 1982
- Applicable data protection and healthcare privacy regulations
The courts of Dhaka, Bangladesh have exclusive jurisdiction over disputes arising from these Terms.
11. ACKNOWLEDGMENT
By using the Diagnofi Platform, you acknowledge that:
- You have read and understood these Terms and Conditions
- You agree to be bound by these Terms
- You understand the limitations and risks associated with digital healthcare services
- You will use Services responsibly and in compliance with applicable laws
